Legislative Update – Indiana Workers’ Compensation Mandate

Effective immediately, Indiana Governor Mike Braun has issued a mandate that there shall be NO open cases pending before the Indiana Workers’ Compensation Board that are over three years old from the date of a filed Application for Adjustment of Claim.

In addition, the Indiana Workers’ Compensation Board has also advised that their goal is for filed cases to be closed within one year of filing an Application for Adjustment of Claim.

What does this mean for our clients? This allows our Indiana attorneys to settle or try disputed cases timelier with the Board’s enforcement of these strict deadlines to obtain our clients the results they deserve.  We understand the unique challenges this presents when Plaintiffs are not at maximum medical improvement (MMI) at the 3-year mark for more severe injuries and have strategies in place for these situations.
