The Petitioner, a traveling nurse, was rear-ended in a motor vehicle accident, leading to neck and low back sprains. Over the years, Petitioner’s complaints escalated to include alleged neurological and psychological issues, which she claimed prevented her from continuing her work as a certified nursing assistant.
Kristin’s defense strategy was centered on Petitioner’s extensive pre-accident treatment and the unsubstantiated nature of her subjective complaints. During the trial, she presented strong medical opinions focusing on objective evidence and provided a thorough rationale against the causation claims.
The arbitrator agreed with Kristin’s arguments, finding that Petitioner failed to prove her neurological, psychological, and ongoing orthopedic conditions were caused by the work accident. Moreover, the arbitrator credited Respondent with an overpayment of TTD benefits, which further reduced the minimal PPD award for the accepted sprains.
