Brian Rosenblatt and Donn LaHaie Published in ISBA’s The Policy

Income members Brian Rosenblatt and Donn LaHaie recently authored articles for the June edition of Illinois State Bar Association’s (ISBA) The Policy. The Policy is ISBA’s insurance law newsletter, providing timely developments and updates on insurance law.

Brian’s article, “Dramatic Expansion of Illinois Workers’ Compensation Rights Leads to Injunction, Nullification and Likely Governor Action” discussed the Illinois Workers’ Compensation Commission’s (IWCC)’s previous Notice of Emergency Amendments to the Illinois Workers’ Compensation Act. Brian covered the lawsuit filed by the Illinois Manufacturers’ Association and the Illinois Retail Merchants’ Association against the IWCC that quickly followed. Brian also provided a breakdown of the restraining order that stopped the enforcement of the newly issued amendments, and why these acts continue to be a topic of discussion.

Donn’s article, “COVID-19 Wrongful Death Lawsuit Alleging Exposure at Work” discusses the first COVID-19 wrongful death lawsuit filed in Cook County where a Wal-Mart employee’s estate alleged the deceased contracted COVID-19 during the course of their employment. Donn broke down the multiple allegations involved in the lawsuit, as well as relevant case law that provides insight on the possible course this case may take.
